Privacy Policy - Applicants
1. Introduction
When you submit an application for a position at Les Deux, we process your personal data in order to manage your recruitment process and/or to fulfill contractual and legal obligations. The purpose of this document is to inform you about how Les Deux processes your personal data.
2. Data Controller

3. Purpose of Processing
We process your personal data for the purpose of:
- Evaluating your qualifications for employment,
- Fulfilling contractual and legal obligations.
Where Les Deux wishes to process your personal data for other purposes that are incompatible with the original purposes for which the data was collected, Les Deux will provide you with information about such purposes.
4. Legal Basis for Processing
The legal basis for processing your personal data for the above purposes will, in most situations, be that the processing is necessary to:
- Fulfill the employment contract or any other contract you are a party to, or to take measures prior to entering into the contract (GDPR Art. 6, sec. 1, litra b),
- Comply with a legal obligation to which Les Deux is subject (GDPR Art. 6, sec. 1, litra c),
- Pursue Les Deux's legitimate interest in conducting the recruitment process, unless your interests or fundamental rights and freedoms take precedence (GDPR Art. 6, sec. 1, litra f).
Where required by data protection law, we will obtain your explicit consent as the legal basis for processing, for example, if it is necessary to obtain your criminal record.
5. Personal Data Processed by Les Deux
As part of the recruitment process, Les Deux collects and processes the following personal data, provided it is permitted under applicable data protection law:
- General identification information, including name, address, email, phone number,
- Information about work experience, references from previous employers, other professional engagements, education, and background-related information, if deemed relevant,
- Information about criminal records (criminal record certificate),
- As a general rule, sensitive personal data such as health information is not processed, but it cannot be excluded that it may be necessary in special situations.
6. Sources of Personal Data Collection
Most personal data is collected directly from you, as well as through observations and deductions made by Les Deux as a result of the recruitment process. The information we request from you may be of such a nature that, without such information, we may not be able to offer you employment, which you will be informed about in advance if this is the case.
7. Processing of Criminal Records
Employment may be conditional on you providing a “clean” criminal record at the start of employment and at any later time as reasonably required by Les Deux.
Les Deux will obtain your explicit consent to process your criminal record.
Les Deux may retain a copy of your criminal record for documentation purposes or choose to note whether a clean criminal record has been presented.
Les Deux does not disclose your criminal record unless required by law.
8. Data Processors and Transfer and Disclosure of Personal Data
Your personal data may be transferred to suppliers, partners, contractual parties, or other third parties processing data on behalf of Les Deux. When using such data processors, Les Deux ensures that a written agreement is in place, requiring the data processor to only process personal data in accordance with Les Deux's instructions and for the purposes specified in this privacy policy. It is required that the data processor establishes sufficient organizational and security measures.
Les Deux discloses your personal data to public authorities to the extent required by a legal obligation.
Les Deux only transfers personal data to countries outside the EU/EEA when appropriate measures are taken to protect them, which is a requirement under data protection law. Transfer of personal data to recipients in third countries will take place with the relevant transfer basis; in most cases, according to the European Commission's standard contracts.
9. Retention Period
Personal data is deleted when there is no longer a legitimate purpose for continued retention. This is in accordance with Les Deux's data protection policy.
If you have submitted an application to us, we generally retain it for 12 months after a rejection is given, after which it is deleted unless you have given consent for longer retention.
10. Your Rights
You have the right to request access to your personal data held by Les Deux. If your personal data is incorrect or misleading, you have the right to request correction of the data. In certain circumstances, you also have the right to request the deletion or restriction of your personal data or to object to the processing, as well as the right to data portability. In cases where our processing is solely based on your explicit consent, you have the right to withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of the processing based on consent before its withdrawal.
